GENERAL CONDITIONS OF SALE

Bon Bon di Benatti Ornella with registered office in Verona, via Cappello 12A, VAT number 04220180238, registered with the Verona Chamber of Commerce, under no. of the register of companies 402697, is the owner of the site http://www.bonbonverona.it (hereinafter "Bon Bon").

Premise

By using the services available on www.bonbonverona.it, the General Terms and Conditions of the Contract described (hereinafter the "Conditions") are fully and unreservedly accepted.
These Conditions apply to all orders placed, by any means provided below, for all items and services offered on www.bonbonverona.it.

Acceptance of the general conditions of sale

This contract is a distance contract pursuant to art. 50 and ss. Of the Legislative Decree 6 September 2005, n. 206 ("Consumer Code"). The Contract concerning the sale of movable goods between Bon Bon Verona di Benatti Ornella and the consumer (hereinafter "Customer") must be considered concluded with the acceptance, even if only partial, of the order by Bon Bon. The acceptance will be sent by Bon Bon to the e-mail address communicated by the Customer when placing the order. By placing an order online, the Customer declares to have read all the information provided to him during the purchase procedure, to have understood them and to fully accept these Conditions and the payment conditions as provided by Bon Bon.
These Conditions and, in particular, the information referred to in art. 52 of the Consumer Code, as provided by Bon Bon, will remain valid and effective until they are modified and / or integrated by Bon Bon. Any changes and / or additions to the Conditions will be effective from the date on which they will be communicated to the public and will apply to sales made from that date. The latest updated version of the Conditions is the one available on Bon Bon. Once the purchase procedure has been completed, the Customer is required to print or save an electronic copy of these General Conditions of Sale.

How to purchase

The Customer can only purchase the Products present in the Bon Bon electronic catalog (hereinafter the "Products" or the "Product") at the time of placing the order and viewable online at www.bonbonverona.it, as well as described in the relevant information sheets. It is understood that the image attached to the description of a Product may not be perfectly representative of its characteristics but differ in color, size, accessories possibly present in the figure.
Correct receipt of the order is confirmed by Bon Bon through an e-mail reply, sent to the e-mail address supplied by the Customer at the time of purchase. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.
In case of non-acceptance of the order, Bon Bon guarantees timely communication to the Customer.
Bon Bon reserves the right to cancel orders deemed unreliable without prior notice. In this circumstance, if the Customer has made the payment and this is already credited, Bon Bon will proceed with the immediate reversal of the total amount of the order.
By purchasing through the Bon Bon site, the Customer will receive a summary e-mail from Bon Bon , with which he will be informed that his purchase proposal is being processed and will be considered accepted, unless otherwise communicated by e-mail or telephone sent by Bon Bon within 3 (three) calendar days from receipt of the summary e-mail.
After this deadline, the Internet Agreement is to be considered perfected.

Terms of payment

All prices include VAT and are displayed next to each product.
Prices on the website www.bonbonverona.it may be subject to change without notice.
The shipping costs will always be displayed automatically together with the order total and before the start of the payment procedure.
Bon Bon provides several payment methods:

  1. Credit card
    Payment can be made with traditional credit cards such as Visa, Mastercard, Maestro, prepaid cards, via Shopify's secure server. At no time during the purchase procedure Bon Bon is able to know the information relating to the buyer's credit card, transmitted via a secure connection directly to the website of the bank that manages the transaction. Since there is no data transmission, there is no possibility that these are intercepted. No Bon Bon computer archive contains or retains such data. In no case Bon Bon can therefore be held responsible for any fraudulent and undue use by third parties, upon payment of Products purchased on the Sites.
  2. Pay Pal
    In case of purchase through the PayPal payment method, at the end of the order the Customer is directed to the login page of the secure PayPal server.
    The amount relating to the order is charged to the PayPal account at the time of order acquisition.
    In case of cancellation of the order, both by the Customer and in case of non-acceptance of Bon Bon , the amount will be refunded to the Customer's PayPal account.
    The cancellation of the order is possible up to the moment in which the same is not yet being processed. Once the cancellation of the transaction has been requested, in no case Bon Bon can be held responsible for any damages, direct or indirect, caused by delay in the failure to release the amount committed by PayPal. At no time during the purchase procedure Bon Bon is able to know the Customer's financial information.
    Since there is no data transmission, there is no possibility that this data will be intercepted. No Bon Bon computer archive contains or retains such data. For each transaction performed with the PayPal account, the Customer will receive a confirmation email from PayPal.
Delivery methods and costs

For orders placed on www.bonbonverona.it, the goods can be sent home by express courier, or collected at the Bon Bon shop in Verona.

Home delivery

Bon Bon can only accept orders for delivery in the territory of the Italian State.
All orders are delivered within 2-5 working days by SDA express courier.
In the event that in the same order there are Products available for immediate delivery together with Products to be ordered, the order will be processed in a single solution upon the arrival of all the Products not immediately available. Bon Bon however, reserves the right to fulfill orders even partially.
The aforementioned delivery times are purely indicative and, although usually respected, Bon Bon does not assume any commitment or guarantee of compliance with them.
In no case, therefore, may direct and / or indirect damages due to delayed delivery be charged to Bon Bon .
In the case of multiple purchases, at the same time, by multiple Customers, Bon Bon reserves the right to check, upon receipt of the order, the availability of the Product and, failing that, to promptly communicate the non-acceptance of the order sent. .

Bon Bon carries out the electronic tracking of its shipments every day to verify the success of the same. In case of difficulty we always take action to try to solve any problems.

As for the delivery address of the package, we recommend to kind Customers to report the address where you are physically present, alternatively opt for the address of the workplace, or of another family member, etc. , carefully filling in all the data (house number, surname on the doorbell, extension number, staircase, etc.) to avoid unpleasant inconveniences.

Upon delivery of the Products by the courier, we advise the Customer to verify that the number of packages corresponds to that indicated in the transport document and that the packaging is intact and does not show any damage or obvious alterations. Any damage to the packaging and / or the product or the mismatch in the number of packages must be immediately contested by the Customer who must put in writing on the copy of the document that remains with the courier the words "RESERVE OF CONTROL", specifying in the most detailed possible motivation: the type of damage, the number of the package, etc. Once the courier's document has been signed, the Customer cannot make any objection about the characteristics of what has been delivered. Bon Bon is not liable in any case for damages not reported following the above procedure.
Any problems concerning the physical integrity, correspondence or completeness of the Products received must be reported within 7 days of delivery by contacting Bon Bon who will open a case of damage, theft or anomaly necessary for the replacement of the goods.
In case of damaged goods, in order to verify the presence and extent of the damage to the physical integrity of the Products caused by transport, everything must necessarily be documented by means of a photograph in digital format, to be attached to the communication addressed to Bon Bon together with the scanning of the courier's bulletin with the specifications of the reserve. In any case, no responsibility can be attributed to Bon Bon in case of delay in the order or delivery of the order.

Shipping fees:

Shipping costs are free for orders over € 80.00.
For orders of less than € 80.00, the Customer will be required to pay the delivery costs which will depend on the destination, weight and volume of the products. The shipping costs will be clearly highlighted in the cart at the time the order is placed, in the case of multiple products the costs are calculated based on the sum of the weight of the Products.


For EU orders and shipping: import taxes or fees are totally up to the client. We can't control custom fees or taxes which are set different among all countries. Wether the order will come back because of refused, we will refund the amount except for the shipping paid and for the return.

We draw the attention of the kind Customer to the days on which the courier, according to its terms of service, does not deliver:

  • on Saturdays and Sundays
  • on midweek holidays
  • during the period of closure for holidays established by the category of hauliers
  • on the days and at the times when circulation on urban and / or extra-urban roads is prohibited by administrative provision
  • on days when, by local custom or by order of the Public Administration, warehouses and / or offices, shops and companies are closed
  • due to force majeure or fortuitous events

Collection at the Bon Bon store in Verona

Thanks to this solution, you can make online purchases on www.bonbonverona.it and directly collect the Products ordered at the Bon Bon shop, located in Via Cappello, 12A - 37121 Verona. As soon as the goods are ready for collection, the Customer will receive a phone call or an e-mail and at that point he can come and collect the purchased Products.
By taking advantage of this opportunity, no shipping costs must be incurred by the Customer.

Right of withdrawal

Pursuant to the Consumer Code, if the Customer is a consumer, he has the right to withdraw from the Purchase Agreement for any reason, without the need to provide explanations and without any penalty. Products ordered specifically for the customer are exempt.
The Right of Withdrawal is not allowed to legal persons (e.g. companies, resellers, etc.) and to natural persons acting for purposes related to their commercial activity.
To exercise the Right of Withdrawal, the Customer must simply send Bon Bon a communication to that effect within 10 days from the date of receipt of the goods. The communication must be sent by email to info@bonbonverona.it, or by registered letter with acknowledgment of receipt or by telegram, addressed to:

Once the notice of withdrawal has been received, Bon Bon will quickly communicate to the Customer the instructions for returning the Products, which will take place within 10 working days of receipt of the return instructions; the costs of redelivery will be entirely borne by the Customer, likewise the cost incurred for the first delivery shipment, which will not be reimbursed.

The right of withdrawal is however subject to the following conditions:
  1. the law applies to Products purchased in their entirety; it is not possible to exercise withdrawal only on part of the purchased Products;
  2. shipping costs (both outward and in a possible return) are always charged to the customer;
  3. Bon Bon products are sold in special packages, in some cases of particular value and value with a specific processing; such packages are considered an integral part of the Products. Therefore, for the purpose of the regular exercise of the Right of Withdrawal by the Customer, the purchased goods must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment to limit damage to the original packaging) .
  4. the shipment, until the certificate of receipt at Bon Bon , is under the full responsibility of the Customer;
  5. in case of damage to the goods during transport, Bon Bon will promptly notify the Customer;
  6. Bon Bon is not responsible in any way for damage, theft or loss of the returned Products;
  7. upon its arrival at Bon Bon , the Product will be examined to assess any damage or tampering not caused by transport. If the package and / or the original packaging are damaged, the Customer will forfeit the Right of Withdrawal as indicated below.

For Products returned intact, Bon Bon will refund the Customer the full amount already paid, by bank transfer or re-credit by credit card, within 14 days of returning the Product. It will be the Customer's responsibility to promptly provide the bank details on which to obtain the reimbursement (ABI Code - CAB - Current Account of the invoice holder).

The Customer will lose the Right of Withdrawal for lack of the essential condition of integrity of the Products (packaging and / or its contents), in cases where Bon Bon ascertains:

  1. the lack or damage of the external packaging;
  2. the lack of the original internal packaging;
  3. the absence of integral elements of the Product (accessories, parts);
  4. damage to the Product for reasons other than its transport

In case of forfeiture of the Right of Withdrawal, Bon Bon will return the purchased good to the Customer, charging the shipping costs to the same and no refund of the price paid will be given.

Request for replacement of an item

The procedure for replacing a Product or its component may be activated as a result of the occurrence of one of the following hypotheses:

  1. a Product different from the one the Customer ordered and, therefore, not present in his order was erroneously sent by Bon Bon . Should this hypothesis occur, the Customer must refrain from opening the package and immediately report the error to Bon Bon by email in order to allow for the appropriate checks;
  2. the purchased Product is not functional from the first use;
  3. the Product is incomplete in some components listed on the Site In each of the cases listed above, the shipping costs will be borne by Bon Bon and the return shipment will be made by express courier.

The Customer who decides to request the replacement of a Product should contact Bon Bon at the e-mail address Bon Bon reserves the right to inspect the Product before accepting or not accepting the return. If all the required conditions are met, the Customer will be replaced with the Product as quickly as possible. In the event that Bon Bon does not have the availability of the Product to be replaced, the same will refund the price of the Product within 10 days of receipt of the Product by bank transfer, upon communication of the bank details by the Customer.
If the return conditions as provided for in this article are not respected, the returned Product will not be accepted and the Customer can choose to have the purchased Product back, paying for the delivery costs. In case of refusal of the shipment Bon Bon reserves the right to withhold the Product and the corresponding amount.

Major force

Bon Bon will not be considered in default of its obligations if the fulfillment is delayed due to a Force Majeure event. Force Majeure means any event beyond the reasonable control of Bon Bon , such as: natural events, terrorist acts, storms, floods, fires, riots, acts of sabotage, ban on trade, strike, suspension of energy, breakdown of equipment, delays in transport due to the same causes reported here as cause of Force Majeure, orders from civil authorities, acts, regulations, ordinances, of any governmental authority, acts of war, interruptions of the Internet service, acts or omissions of the Customer . The contractual deadlines are postponed for the time necessary to overcome the consequences of a Force Majeure cause. In the event that the Force Majeure event lasts for more than 1 month, both parties will be able to terminate the contract and the parties will agree in good faith on the consequences of such termination.

Conformity of products

Bon Bon declares that all the Products present in the catalog and marketed comply with the standards and approved according to the European Union regulations. Bon Bon is not liable in the event of any discrepancies with respect to the standards of countries not belonging to the European Union and / or their failure to homologate the Products themselves in said countries.

Jurisdiction

This sales contract is concluded in Italy and governed by Italian law. For the solution of disputes arising from the conclusion, interpretation and execution of this Agreement, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his / her town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Verona.
